Temple Wines recommends that you carefully read the Terms and Conditions below.
By accessing and using this Website, the user declares to have read, understood and accepted the Terms and Conditions presented, without the need for any subsequent act or consent.
Access and use of other Temple Wines platforms are likewise regulated by these Terms and Conditions to the extent applicable and with the respective adaptations.
The Terms and Conditions may be changed at any time, considering that the changes take effect from the date of their update on the website. Subsequent access and use of the website or platforms by the user will be considered an unequivocal sign that the user has read, understood and accepted the new changes to the Terms and Conditions.
1. Object
1.1 These General Conditions in force, updated in May 2021, are intended, together with the order form, and the other elements referred to therein, to regulate the terms and conditions governing the provision of the Service Temple Wines Online Store (share company, headquartered at R. Vasco da Gama 239, 2785-595 São Domingos de Rana under the unique registration and identification number of legal person nº 516822845, hereinafter referred to as Temple Wines Lda.
1.2 The purchase of any product in the Temple Wines Online Store implies acceptance of these General Conditions of Sale Online.
1.3 Any and all alcoholic beverages available for sale on the Temple Wines Online Store may only be purchased by persons of legal age in their country of residence.
2. Information on Products, Contents, Prices and Stocks
2.1 Temple Wines reserves the right to modify, without prior notice and at any time, the information and commercial offer presented on: products, prices, promotions, commercial conditions and services.
2.2 The images that illustrate each product at Temple Wines are merely illustrative (unless specified) and may differ from the product later delivered, and these same products are also subject to out of stock. In the event that the images contain a year or specific information, the title and reference of the web page of the products in question must always be assumed and never the information contained in the image itself. Temple Wines is not responsible for any typographical errors due to computer or translation reasons.
2.3 Despite Temple Wines' efforts, some products may have an inaccurate price, which is why the team checks prices whenever they process orders. Consequently, the prices shown at Temple Wines are merely indicative and do not constitute a contractual offer. If the actual price of the product is lower than the advertised price, Temple Wines will refund the difference. If the price is higher, Temple Wines will inform the customer of this situation by email and will wait for their decision to accept the new price or cancel the order within 15 days from the date on which the email was sent.
2.4 Some products at Temple Wines may not show the Year of harvest or vintage, so the current market harvest or vintage should always be assumed.
2.5 As they are different stock counting systems between the online store and the showroom, there may be differences in the quantities presented online.
In the event that any of the ordered products is out of stock, Temple Wines reserves the right to notify the customer, who may choose one of the following options:
- a) refund of the amount referring to the product in question;
- b) total cancellation of the order and respective refund of the amount;
- c) another in agreement with both parties
Under no circumstances may the customer demand the delivery of paid goods, without first having confirmation that it is available for collection or delivery. This confirmation will always be sent via email after the order summary email (which is sent when the order is paid). If there is actually a shortage of stock, the customer may take one of the decisions indicated above.
2.6 When making the purchase, the customer will immediately receive an email with a document attached with the order form which will contain a summary of the options registered by the customer. This email/document should not be assumed as the final confirmation of the order. This confirmation will be sent later, as mentioned in the previous point, after physical validation of stocks.
2.7 Under Portuguese law, all prices shown on Temple Wines include the respective VAT rates in force, unless otherwise stated. Only and only for resale professionals, the values presented at Temple Wines do not include VAT, and the information “Without VAT” is always visible and next to the price.
2.8 The promotions published on the Temple Wines website may not be applicable to products in the showroom.
3. Order and Payment
3.1 After confirming the order at Temple Wines, an email will be sent to the contact address registered by the customer at the time of formalization, with all the details about delivery, billing, payment information, products and values. Temple Wines suggests that all customers confirm its details. If the customer does not receive the order confirmation email, they are requested to contact Temple Wines via email info@templewines.eu so that this notification is sent again to the email address of the customer.
3.2 If any of the details placed by the customer in the order are wrong and/or the customer wishes to change some information, as long as the order has not yet been shipped, the customer is requested to contact us via email info@templewines.eu as soon as possible so that the change requested by the customer can be made internally. Changes to details of orders already shipped will have to be analyzed by the Temple Wines team so that, together with the customer, a more adequate solution can be found.
3.3 The customer is requested to mention at least one telephone contact at the time of account registration, for delivery purposes when the goods are shipped. If the customer does not provide such contact and the delivery of the order does not take place due to failure of communication with the customer due to the lack of said telephone contact, the goods will return to the Temple Wines warehouse, where they will be held until further contact with the customer and after analysis by the Temple Wines team, resent with the addition of new shipping costs, if applicable.
3.4 All orders at Temple Wines will only be processed after the effective receipt of payment, which will constitute the date of confirmation of the same. The formalization of the order alone does not constitute a reservation of the products.
3.5 If an order cannot be partially or fully satisfied, the customer will be contacted by Temple Wines in order to find the most appropriate solution
3.6 Orders may be canceled when expressly requested by the customer through one of the following e-mails info@templewines.eu before the orders are shipped. After confirming the dispatch of the order, the customer is asked to contact Temple Wines so that, together with him, the most appropriate solution can be found. For more information on cancellation and related refunds and fees, see point 6.
3.7 Payments by credit card or Paypal are accepted through the Temple Wines Online Store.
3.8 The status of orders at Temple Wines is comprised of 3 phases, exceptionally 4: Pending, In Process, On Hold and Finished.
- a) Pending – Waiting for the payment to enter the Temple Wines system;
- b) In Processing - Phase in which the payment was accepted, and the order is in processing and packaging/preparation;
- c) On Hold – Exceptionally, it waits for additional confirmations with the customer to proceed with the order.
- d) Finished – The order has already been shipped.
3.9 Payments are received in euros, regardless of the currency in which the transaction is carried out, the conversion fees for payments made in other currencies must be borne by the customer.
4. Shipping costs
4.1 To the prices shown on the products, the respective value of the postage is added, for each order.
4.2 At Temple Wines there is no packaging cost and the shipping cost depends on the weight of the order and the respective delivery destination. The cost of shipping will always depend on the shipping method/carrier selected, assigned in the 4th Step (Shipping) of the shopping cart. The total shipping costs will also be automatically calculated when placing your order in the Online Store. It should be noted that the factors of this calculation may be variable and change without prior notice, not depending exclusively on Temple Wines.
5. Shipments and Deliveries
5.1 For orders to be sent to the requested address, the shipping option - Carrier for national or international shipments must be chosen.
5.2 Normally, after dispatch, an order at Temple Wines takes a long time to be delivered
- 24 to 72 hours in mainland Portugal;
- Between 5 to 9 working days in Madeira and Azores Islands;
- About 4 working days in Peninsular Spain;
- About 6 to 9 working days in the rest of Europe;
5.3 After the orders are dispatched, the customer may request information to monitor the shipment and a notification will be sent via email with the information of the link for monitoring the same to the registered customer. If for any reason the customer does not receive the shipment confirmation, he is requested to contact Temple Wines via the following email info@templewines.eu to be sent again all available information about the shipment of the order.
5.4 After notification of dispatch, customers must follow the status of the shipment through the link provided by Temple Wines, so that they are aware of the state of evolution until the moment of delivery of the order, since Temple Wines does not notifies each shipment status change. Likewise, it should be noted that not all transport services have a shipment monitoring information service.
5.5 All products sent by Temple Wines must be checked upon delivery If the customer finds that the order is damaged, he must immediately return it to the transport company, duly justify the reason for the return on the carrier's delivery note and immediately notify Temple Wines via email info@templewines.eu
5.6 If, after delivery, the customer finds that any of the items is not in compliance, he is requested to contact Temple Wines immediately via email info@templewines.eu indicating the order number or the of the document that accompanied the order, attaching images of the packaging as received and of all the items, so that the process of investigating the occurrence can be opened internally and in this way the situation can be resolved as soon as possible.
5.7 Temple Wines is not responsible for shipments made to countries where the respective law does not allow the entry of alcoholic beverages. Customers are responsible for the eventual seizure of their orders, as well as the payment of customs fees, if any. In case of returning products, Temple Wines will only refund the amount corresponding to these same products in which their good condition is verified, not guaranteeing the refund of products that have been damaged or poorly stored during transport.
5.8 Temple Wines has contracted services with specialized carriers for the purpose of deliveries in Portugal, Europe and most countries in the world. Every effort is made to meet the shipping and delivery deadlines, however it should be noted that possible delays in deliveries may be unrelated to Temple Wines, and in these cases it is not possible to guarantee exact delivery times.
5.9 In case of unsuccessful delivery by the carrier, due to the customer's absence, a notice of passage may be left in the customer's mailbox with the carrier's instructions. Depending on the service and the carrier, orders must be collected at the place indicated by the same in the ticket notice, or the directions requested in the same notice must be followed.
6. Cancellation and Returns Policy
6.1 Temple Wines recognizes to all its customers the right to terminate the contracts they enter into, allowing them to return, within 14 days, the products purchased under the terms of Decree-Law nº24/2014, of February 14th.
6.2 The cancellation or return process is handled on a case-by-case basis by Temple Wines. To request an exchange or return, the customer is requested to contact Temple Wines via email info@templewines.eu up to 14 days after the actual receipt of physical possession of the goods (order(s)), indicating the order number or the number of the document that accompanied the order, taking into account the conditions detailed below in the following topics:
- a) In order to return the order, the product must be in perfect sales condition, and, where applicable, with its original packaging, accessories or promotional offers included, and accompanied by proof of purchase or invoice.
- b) The cost of transport for returning the product to Temple Wines is the responsibility of the customer
- c) Temple Wines is responsible for the shipping and collection costs in the case of defective products and wrong shipments, unless this mistake is attributable to the consumer.
- d) Once the goods have been received at our facilities and after validating their condition accordingly, their value will be returned via the same payment method (see point 6), but if this is not possible, the customer must present proof of payment and account or card ownership, so that the return can be made by Bank Transfer
- e) Temple Wines undertakes to reimburse the customer within a maximum period of 14 days from the date on which it is informed of the decision to terminate the contract of all payments received, including the costs of delivery of the good, , however, the consumer will bear the cost of returning the good, under the terms of paragraph 2 of article 13 of Decree-Law nº 24/2014, of 14 February.
Refunds for payments must be made by the same payment method used by the consumer in the initial transaction, unless expressly agreed to the contrary and provided that the consumer does not incur any costs as a result of the refund.
- f) If the value resulting from the exchange of products of an order is lower or higher than the initial value of the same, the conditions of settlement will be indicated by Temple Wines.

6.3 Temple Wines assumes the responsibility arising from defects in origin or raw material of the product purchased and if this is confirmed by the specialized team of Temple Wines, the product will be exchanged or returned at no cost to the client.
6.4 Temple Wines will not accept the return of the product after it has been used, or if it has been altered or modified.
6.5 Temple Wines is not responsible for deficiencies resulting from incorrect use, negligence, poor storage conditions or force majeure.
6.6 The conditions described in the previous points 6.1 to 6.6 apply to Mainland Portugal. For the remaining Zones and/or Countries, points 6.1 to 6.8.

6.8 For Zones and/or Countries other than Mainland Portugal, therefore, Archipelagos of Madeira and Azores, Europe and Rest of the World, the cost inherent to the return of the good/order is borne by the consumer, and Temple Wines is responsible for returning or reimburse the consumer for all payments received, including the costs of delivering the goods, under the terms of paragraph 2 of article 13 of Decree-Law nº 24/2014, of 14 February, which will be made by the same means of payment that you have been used by the consumer in the initial transaction, unless expressly agreed to the contrary and provided that the consumer does not incur any costs as a result of the refund.
7. Applicable Law
7.1 All purchases made on the Temple Wines website are subject to Portuguese legislation. Any conflict or divergence of interpretation of the General Terms & Conditions of Online Sale will be submitted to the competent Portuguese Court.
7.2 If the Customer is located outside mainland Portugal, Temple Wines informs you that any legal process must be brought exclusively in the Portuguese Courts.

7.4 Decree-Law no.74/2017, of 21 June, regulated by Ordinance nº201-A/2017, established the creation of an online Complaints Book, available at wwwlivroreclamacoes.pt (Platform Digital), which allows consumers and users, among other tools, to present complaints in a dematerialized form, with the same value as complaints presented in physical format.
